Terms and Conditions of Sale
1.
GENERAL
All quotations are made, and all orders are accepted,
only subject to the following terms and conditions
not withstanding anything, which may be stated
to the contrary on customers order forms, or correspondence.
2. VALIDITY
Unless previously withdrawn, all quotations are
open for acceptance within 30 days only from the
date thereof, and are subject to confirmation
at the time of such acceptance.
3. DESCRIPTIVE MATTER
All descriptive specifications, drawings and particulars
of weights and dimensions issued by us are approximate
only and intended only to present a general idea
of the goods to which they refer and none of these
shall form part of the contract.
4. SPECIAL MATERIAL
Orders for goods that are built or non-stocking
items ordered-in to special requirements are only
accepted on the condition that cancellation or
return cannot be accepted.
5. PRICES
All prices in our catalogues and lists are subject
to alteration or withdrawal without notice. Prices
are quoted excluding VAT, which will be charged
at the current rate.
6. TERMS OF PAYMENT
Payment is required on or before despatch date,
unless otherwise agreed at the time of order.
Any credit account will be established at CA Clase's
discretion after receipt of two trade references
and one bank reference. Such an account will be
due for full settlement within 30 days from the
date of transaction, late payment will incur interest
charges at 2.5% per month.
7. INSURANCE FOR GOODS IN TRANSIT
Insurance for Goods in Transit is to be arranged
by the customer.
8. DESPATCH AND FREIGHT/PACKING CHARGES
The time given for despatch will date from our
formal acknowledgement of a written order. We
will use our best endeavors to despatch on the
date given, but will accept no liability to do
so. Freight and packing charges will be added
to quoted prices. Alternatively goods may be collected
from CA Clase (UK) Limited premises.
9. LEGAL CONSTRUCTION
This contract shall in all respects be constructed
to operate as an English contract and in conformity
with English Law.
10. CANCELLATION
Once orders have been accepted by us, they cannot
be cancelled except with our written agreement.
In this event we reserve the right to raise a
cancellation charge. For returned goods a re-stocking
fee applies.
11. TITLE OF GOODS
Title of goods shall not pass from CA Clase (UK)
Limited until full and final payment has been
received.
12. WARRANTY
CA Clase (UK) Limited pass on the full benefit
of the Manufacturer’s warranty for the products
the company represents, the scope of the warranty
is product specific – please see individual
products for details. The warranty specifically
excludes damage or misuse by whatever means excluding
product failure as defined by the manufacturer.
CA Clase (UK) Limited accept no liability for
consequential losses incurred by any product failure.
13. PRIOR INSPECTION
Inspection at our Waterlooville premises is invited
prior to despatch when appropriate.
14. CA CLASE ARRANGED PROGRAMMING / AIRTIME
Compatibility of programming with reception hardware
provided by the client, cannot be warranted by
CA Clase (UK) Limited. We will use the best endeavors
to advise on compatibility.
Terms specific to Satellite Television receiving
equipment
15. SATELLITE PROGRAMME PROVIDER
CA Clase (UK) Limited cannot be held responsible
for the whims or changes of policy, bankruptcy
or takeover of program services provided, should
they move satellites, change beams, polarity frequency
and encryption method or satellite. Our offers
are made in good faith, based on the best information
available at the time of the quotation; it is
the client’s duty to be aware of the service
being contracted.
16. RECEPTION OF SATELLITE TV BROADCASTS
Reception of Satellite Television at sea, is dependent
on a number of factors, quite different from parameters
associated with reception on land. The antenna
must be in the satellite's footprint (signal)
with sufficient strength relevant to the antenna
size supplied. Reception equipment varies from
broadcast to broadcast on the same satellite and
indeed from satellite to satellite, so must be
appropriate to the channel of choice. Blockage
– Line of sight must be maintained to provide
the data stream to the receiver.
